These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and InFieldTek LLC, a Wyoming limited liability company ("InFieldTek," "we," "us," or "our"), operating the FieldTek platform and all associated services ("FieldTek" or the "Service").
By accessing or using FieldTek — including by texting our designated phone numbers, visiting fieldtek.co, or creating an account — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using FieldTek on behalf of a business, you represent and warrant that you have the authority to bind that business to these Terms, and references to "you" shall include both you and the business.
If you do not agree to these Terms, you must immediately discontinue use of the Service.
To create an account and subscribe to FieldTek as an account holder, you must be at least 18 years of age and legally capable of entering into binding contracts under applicable law.
Team members, crew members, and other users added to an account by an account holder are not subject to an age minimum, provided their account holder accepts responsibility for their use of the Service under these Terms.
FieldTek is intended for use by businesses and professionals. By using the Service, you represent that you are using it for legitimate business purposes.
FieldTek is an agentic artificial intelligence platform that provides business management services to trade contractors and small businesses, delivered primarily through SMS text messaging, voice, and web interfaces. The Service includes but is not limited to:
FieldTek is powered by third-party artificial intelligence providers including Anthropic, Google, and others. The capabilities and availability of AI-powered features may change over time as these underlying technologies evolve.
You may initiate a FieldTek account by texting our designated phone number or completing the registration form at fieldtek.co. By registering, you agree to provide accurate, current, and complete information.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at kevindonahue@fieldtek.co if you suspect unauthorized access to your account.
Account holders are responsible for all users added to their account, including crew members and team members. You agree to ensure that all users on your account comply with these Terms.
InFieldTek reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Service.
FieldTek offers several subscription tiers including FieldTek Pro, FieldTek Elite, FieldTek Enterprise, and FieldTek Seasonal, each with different features, message allowances, and pricing. Current pricing is available at fieldtek.co and is subject to change with notice.
All subscriptions are billed on a monthly basis through Stripe. By providing payment information, you authorize InFieldTek to charge your payment method for the applicable subscription fees.
FieldTek offers a 7-day free trial for new accounts. No credit card is required to begin a trial. At the end of the trial period, your account will be suspended unless you select a paid plan. Trial data is held for 30 days following trial expiration before permanent deletion.
Message credits are shared across all users on a single account. Pro accounts receive 500 shared credits per month. Elite accounts receive a soft throttle of 2,000 shared credits per month. Different tasks consume different credit amounts based on computational complexity.
InFieldTek reserves the right to modify subscription pricing with at least 30 days written notice to account holders. Continued use of the Service following a price change constitutes acceptance of the new pricing.
FieldTek subscriptions are billed monthly. We do not offer prorated refunds for partial months of service. If you cancel your subscription, you will retain access to the Service through the end of your current billing period.
In cases of documented technical failure on our part that renders the Service substantially unusable for an extended period, InFieldTek may, at its sole discretion, provide service credits or partial refunds. All refund requests must be submitted to kevindonahue@fieldtek.co within 30 days of the billing date in question.
Free trial periods are not eligible for refunds.
You agree to use FieldTek only for lawful business purposes and in accordance with these Terms. You agree not to:
InFieldTek reserves the right to investigate and take appropriate action against any user who violates these provisions, including suspension or termination of access without refund.
FieldTek uses artificial intelligence to generate quotes, invoices, job estimates, blueprint analyses, G-code for CNC machining, and other business documents. YOU ACKNOWLEDGE AND AGREE THAT:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INFIELDTEK EXPRESSLY DISCLAIMS ALL LIABILITY FOR ERRORS, OMISSIONS, OR INACCURACIES IN AI-GENERATED CONTENT.
FieldTek is an SMS-first platform. By creating an account or texting our designated phone numbers, you expressly consent to receive text messages from FieldTek related to your account, including transactional messages, service notifications, and operational communications.
By adding crew members or team members to your account, you represent and warrant that you have obtained all necessary consents from those individuals to receive text messages from FieldTek on your behalf, and that such individuals have agreed to these Terms.
Standard message and data rates may apply to SMS communications. FieldTek is not responsible for any charges imposed by your mobile carrier.
You may opt out of non-essential communications at any time by texting STOP to our designated number. Opting out of transactional or operational messages may limit your ability to use the Service.
FieldTek uses Twilio, Inc. as its SMS delivery provider. Message delivery is subject to carrier availability and Twilio's terms of service. InFieldTek is not responsible for delayed, failed, or undelivered messages.
FieldTek offers optional payment processing services through Stripe Connect, which allows contractors to accept payments from their customers through the FieldTek platform. This feature is subject to Stripe's Terms of Service and Connected Account Agreement, which you must accept separately.
When using FieldTek payment processing, InFieldTek acts as a platform facilitator only. We do not hold, store, or have custody of contractor funds at any time. Funds flow directly from customers to contractor bank accounts through Stripe's infrastructure.
InFieldTek retains a platform fee of 0.5% to 1% per transaction processed through FieldTek payment processing. This fee is disclosed at the time of onboarding and before processing any transactions.
You are responsible for all applicable taxes on payments received through the Service. InFieldTek does not collect, withhold, or remit taxes on your behalf.
FieldTek offers an emergency call facilitation feature that, upon your request, can attempt to connect you with emergency services (911) via a three-way telephone conference. THIS FEATURE IS SUBJECT TO THE FOLLOWING CRITICAL LIMITATIONS:
ALWAYS CALL 911 DIRECTLY IN AN EMERGENCY. Do not rely on FieldTek as your primary means of contacting emergency services.
The FieldTek platform, including its software, design, trademarks, logos, and content, is the property of InFieldTek LLC and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any portion of the Service without express written permission.
You retain all ownership rights to the data, documents, photos, and content you submit to FieldTek ("Your Content"). By submitting Your Content, you grant InFieldTek a limited, non-exclusive license to process, store, and use Your Content solely for the purpose of providing the Service to you.
InFieldTek does not claim ownership of Your Content and will not use Your Content for any purpose other than providing the Service and as described in our Privacy Policy.
InFieldTek collects and processes personal data in accordance with our Privacy Policy, available at fieldtek.co/privacy.
By using FieldTek, you consent to the collection, processing, and storage of your data as described in our Privacy Policy.
You are responsible for ensuring that any data you submit about third parties is submitted lawfully and with appropriate consent from those individuals.
FieldTek integrates with third-party services including QuickBooks Online, Stripe, Twilio, Anthropic, Google, Deepgram, ElevenLabs, and others. Your use of these integrations is subject to the respective terms of service and privacy policies of those providers.
InFieldTek is not responsible for the availability, accuracy, or performance of third-party services and is not liable for any harm resulting from your use of third-party integrations.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INFIELDTEK'S TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO INFIELDTEK IN THE THREE MONTHS PRECEDING THE CLAIM.
IN NO EVENT SHALL INFIELDTEK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION.
You agree to indemnify, defend, and hold harmless InFieldTek LLC, its members, managers, employees, agents, and successors from and against any claims, damages, losses, costs, and expenses arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your infringement of any third-party rights.
Either party may terminate these Terms at any time. You may terminate by canceling your subscription and ceasing use of the Service. InFieldTek may terminate or suspend your account immediately if you violate these Terms.
Following account cancellation, InFieldTek will retain your data for 30 days before permanent deletion, during which time you may request data export by contacting kevindonahue@fieldtek.co.
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall first be submitted to good-faith negotiation between the parties. If negotiation fails, disputes shall be resolved in the state or federal courts located in Wyoming.
InFieldTek reserves the right to modify these Terms at any time. When we make material changes, we will notify you by SMS to your registered number at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the updated Terms.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and InFieldTek regarding the Service.
If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
